Terms of Service
These terms govern your use of the ShotsGlow website and software. Purchases are handled by our Merchant of Record, Polar — see section 2.
1. Provider
ShotsGlow is operated by Max Fischer — MXF Labs (sole proprietorship), Lammersdorfer Straße 2, 52159 Roetgen, Germany, [email protected] (“we”, “us”). See our Legal Notice.
2. Purchases & your contract (Merchant of Record)
ShotsGlow is sold through Polar Software, Inc., which acts as our Merchant of Record. When you buy a licence, your purchase contract is concluded with Polar, and Polar is responsible for payment processing, invoicing, taxes (incl. VAT) and the statutory right of withdrawal. Polar's terms and policies apply to the transaction — polar.sh/legal/terms. The licence terms for using the software (sections 3–4 below) are between you and us.
3. Licence
On purchase you receive a personal, non-exclusive, non-transferable licence to use ShotsGlow. The licence is a one-time purchase with lifetime updates — there is no subscription. One licence may be activated on up to two of your own computers, and you can move it between them from inside the app.
You may not:
- resell, sublicense, rent or share your licence key;
- reverse-engineer, decompile or circumvent the licence mechanism, except where such restriction is prohibited by mandatory law;
- remove or alter any proprietary notices.
4. Delivery
After purchase your licence key is shown on the confirmation page and sent to your email. The application is delivered as a download from this website. ShotsGlow runs locally on your device and works offline after activation.
5. Price
The price shown at checkout at the time of purchase applies. ShotsGlow uses a founding price that increases in steps as early licences sell; the price you see and confirm at checkout is the price you pay.
6. 30-day money-back guarantee & right of withdrawal
On top of your statutory rights, we offer a voluntary 30-day money-back guarantee: if ShotsGlow isn't for you, email [email protected] within 30 days of purchase and we will arrange a refund, no questions asked.
As a consumer you also have a statutory right of withdrawal for digital purchases. Because the software is supplied as digital content immediately after purchase, this statutory withdrawal right can lapse once performance has begun with your prior consent and acknowledgement. The right of withdrawal and refunds for the purchase are handled by Polar as Merchant of Record (section 2); our voluntary guarantee above applies regardless.
7. Updates & availability
The licence includes updates to ShotsGlow at no extra cost. We do not, however, guarantee any particular feature, future development, or uninterrupted availability of the website or the download service.
8. Warranty
Your statutory warranty rights apply. Beyond these, the software is provided to the extent permitted by law “as is”; we do not warrant that it will be error-free or meet every individual requirement.
9. Liability
We are liable without limitation for damages caused intentionally or by gross negligence, and for injury to life, body or health. For slight negligence we are liable only for the breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place), and limited to the foreseeable, contract-typical damage. Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.
10. Governing law
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.
11. Changes
We may update these terms; the version published here at the time of your purchase or use applies. Material changes will be reflected on this page.
